This Privacy Policy Statement, Terms and Principles has been published to provide a clear and concise outline of how and when personal information is collected, disclosed, used, stored and otherwise handled by the Burlington Jazz and Blues Festival Inc., also known as the Burlington Jazz'n Blues Festival, its subsidiaries, its associated Web sites and other related companies owned and operated by the Burlington Jazz and Blues Festival Inc. (also known hereafter collectively and individually in these Privacy Policy Statement, Terms and Principles as the "Web site Network"). You are agreeing to be legally bound by these terms as modified from time to time. Any use of the "Web site Network" by you after such changes are posted constitutes your agreement within the Terms of Use and also within the Privacy Policy Statement, Terms and Principles as modified.
Before using the "Web site Network", it is your responsibility to read the Privacy Policy Statement, Terms and Principles and its Terms of Use fully. It is also your responsibility to notify us in the manner set out within this proceeding policy if you do not want us to collect information about you, and reject any cookies in the manner set out therein.
The Basic Principles
We are determined to protect your privacy! It is very important to us that you should be able to use and enjoy our "Web site Network" without having to compromise your privacy unacceptably.
Knowing something about our users is, however, necessary to ensure that our service is continually improved. User Agreement
By accessing, participating and using the "Web site Network" you are agreeing to be legally bound by its Privacy Policy Terms and Principals as outlined herein. By using burlingtonjazzfestival.com, the official Burlington Jazz and Blues Festival Inc. Web site, including any owned, operated and managed Web sites within its "Web site Network" as stated above, signifies your consent to said terms, practices, and privacy policy principles. You should therefore also read the Terms of Use before using the "Web site Network" including but not limited to its online Forums, Festival sites, E-commerce sites and Contest sites. You should always check this privacy statement from time to time as it may change without notice. Your continued use of the "Web site Network" after any future modifications have been made to this privacy policy indicates your acceptance to all the terms and conditions of our revised privacy policy statements, terms and princples as outlined therein.
Consent
The "Web site Network" may collect personal information only if site users voluntarily give it to us. Users are under no obligation to give us personal information and need not do so to access most of our "Web site Network" band of sites. By volunteering this information, users agree to its collection for the purposes outlined herein.
The "Web site Network" treats the handling of your personal information VERY SERIOUSLY. To that end, the "Web site Network" has systems and procedures in place to protect your privacy in relation to the handling of your personal information.
Simply put, the "Web site Network" does not collect personal information about you unless you specifically and knowingly choose to provide such information to us. Instances where the "Web site Network" may collect information about you include but not limited to instances when you enter contest(s); when you complete one of our online registration forms; when you send us an email requesting information; when you make on online purchase or complete an order form digitally, electronically, non-electronically or by other means not mentioned.
If you are the winner of one of our contests, congratulations, you agree that your name and city of residence will be published by us on the "Web site Network" band of sites. You also agree that your name and city of residence may also be used by other third party media publishing organizations for purposes including but not limited to public notices, press releases, news mentions, public announcements, and other media broadcasting means including television and radio for marketing and promotional purposes of the Burlington Jazz and Blues Festival Inc.
Purpose
The "Web site Network" may use the personal information we collect from you to:
- provide users with e-mail updates (if requested) of events, contests, and activities of the Burlington Jazz and Blues Festival and/or other "Web site Network" related activities of interest.
- process e-commerce orders through our secure electronic storefront;
- obtain user feedback concerning the "Web site Network" and its related Web sites; and/or
- keep aggregate information concerning Web site(s) use.
Collection of Personal Information
We may also ask you to provide personal information on a voluntary basis in order to get a clearer picture of our users. It is then entirely up to you whether you are happy to give us this information.
In the course of entering competitions, promotions and other online offers you will be asked to give some details about yourself. You may also choose to e-mail us or make contact with us in other ways. Such contact gives us information about you.
If you have any financial dealings or make purchases with one of our partners on co-branded sites, they will ask for certain information. This information may be shared with us.
Personal information is information or opinion from which an individual's identity may be ascertained. The nature of personal information collected by the "Web site Network" generally comprises an individual's name and contact details (including but not limited to mailing address, phone, fax and e-mail etc). Such personal information is collected for the purposes of arranging, conducting and promoting the "Web site Network" and/or Festival special events, productions and broadcasting activities among other endeavors.
The "Web site Network" also collects other types of personal information from time to time (eg. credit information and drivers licence details etc), and will inform you upon collecting such information for the purpose in which it is being collected. Such information is used for making purchases on the "Web site Network" e-commerce and other store-front web pages.
a. E-mail Updates: When a user subscribes to e-mail updates from the "Web site Network", we may collect some or all of the following personal information:

b. E-Commerce Transactions: When a user purchases an item using a credit card from one of our "Web site Network" secure online shopping Web sites, some or all of the following personal information is collected:

- Credit Card Number, Type, and Expiration Date

The "Web site Network" does not collect personal information unless it is necessary for the "Web site Network" to perform one or more of its functions and activities. On occasion, some of this personal information may be sensitive and the "Web site Network" will only collect it with your consent or when required to by law.
The "Web site Network" will also in some cases collect personal information from you directly. For example, the "Web site Network" may collect personal information via telephone or letter, or when you attend a function or event, enter competitions and contests, provide a resume or enter into an agreement with us.
Apart from other companies in the "Web site Network" group, we only share personal information about you with third parties whom we have selected carefully and with whom we have, or may have, a commercial relationship. The "Web site Network" complies with the relevant legal requirements and takes all reasonable care to ensure that your information is secure and private and is only seen by responsible third parties. However we cannot be held responsible for the actions of any third party who receives or obtains access to the information, nor for any breach of security.
If you tell us that you do not want us to use your details, then data about your use of the Web Site would then only form part of aggregated statistics and would not be related to you as an individual.
There may be other occasions when the "Web site Network" needs to source personal information from an external third party. For example, the "Web site Network" may collect personal information from credit agencies when establishing a credit account. The "Web site Network" may also collect personal information from contact call centres involved in competitions, contests, promotions or other direct marketing campaigns on behalf of the "Web site Network" or its associated organizations.
Making Online Purchases
When a user purchases an item from a "Web site Network" secure online shopping cart, any purchase order number(s), user ID's, tokens, and passwords provided to process your order(s) are used to authenticate the user. Account information stored in our database may include: account primary contact name and information, company name, mailing address, email address, and User ID and password issued to access your account online.
We use industry-standard e-commerce security technology to protect any personal information you transmit to us when purchasing by credit card or by a purchase order account in our electronic stores. This e-commerce security includes:
- encrypting the information you input using Secure Socket Layer (SSL) software;
- authenticating the identity of our customer to prevent fraudulent transactions on either end by using digital ID and encryption technologies methods which are widely used by online retailers. The lock icon in some browsers indicate that the Digital IDs are valid on the site you are using; and,
- storing only the last 4 digits of your credit card number when confirming an order.
Note: Protect your password when using a shared computer. Make sure to sign off and close your browser window.
Non-Personal and Aggregated Information Collected Automatically
Each time you visit one of our Web sites, we log non-personal information, such as your IP address, domain name, the name of the Web page from which you entered and came from, which pages you visit on our "Web site Network" of sites, what search methods you used to find our Web sites, and how much time you spend on each page. We use this information primarilty to monitor and improve our "Web site Network" band of Web sites and for internal analysis only. In particular, we use IP addresses to analyze trends, administer these Web sites, and gather information for aggregate use. IP addresses are not linked to personally identifiable information.
Use of Cookies
The basic principles:
A cookie is a text-only string of information that a Web site transfers to the cookie file of the browser of your computer's hard disk so that the Web site can remember who you are. A cookie will typically contain the name of the domain from which the cookie has come, the "lifetime" of the cookie, and a value, usually a randomly generated unique number.
Two types of cookies are used on the "Web site Network" band of Web sites.
Session Cookies, which are temporary cookies that remain in the cookie file of your browser until you leave the "Web site Network".
Persistent Cookies, which remain in the cookie file of your browser for much longer (though how long will depend on the lifetime of each specific cookie). How we collect cookies on the "Web site Network" and what information we collect:
Session Cookies: To allow you to carry information across pages of the "Web site Network" and avoid having to re-enter information.
Persistent Cookies: To help us recognize you as a unique visitor (just a number) when you return to the "Web site Network" and to allow us to tailor content, advertisements and the presentation of the Web sites to match your preferences. To compile anonymous, aggregated statistics that allow us to understand how users use the "Web site Network" and to help us improve the structure of the "Web site Network". We cannot identify you personally in this way.
Third Party Cookies:
Third parties serve cookies via the "Web site Network". These are used for the following purposes: To serve advertisements on the "Web site Network" and track whether these advertisements are clicked on by users. To control how often you are shown a particular advertisement. To count the number of anonymous users of the "Web site Network". To provide security within transactions.
We automatically collect some data about our users' browsing actions and patterns. Cookies enable us to process your order during the secure checkout process in our online stores. We place a unique identifier in the cookie and use it to connect your computer with the information we store for you in our order database. Without cookies enabled, you will not be able to order a product online. We do not use cookies to store any personal or financial information on your computer.
Use of Web Beacons
Some of our web pages within the "Web site Network" may contain electronic images known as web beacons (sometimes known as clear gifs) that allow us to count users who have visited these pages. Web beacons collect only limited information which may include a cookie number, time and date of a page view, and a description of the page on which the web beacon resides. We may also carry web beacons placed by third party advertisers. These beacons do not carry any personally identifiable information and are only used to track the effectiveness of a particular campaign.
Disabling/Enabling Cookies.
You have the ability to accept or decline cookies by modifying the settings in your browser. However, you may not be able to use all the interactive features of the Web site if cookies are disabled.
Web Site Usage Statistics: The "Web site Network" also collects non-personally-identifiable information that becomes available as a result of a user's visit to our Web site(s). Information that is automatically collected includes the user's:
- IP address (a number automatically assigned to your computer when you visit a Web site. Our server automatically logs the user's IP address); and
- Your country and city of origin from which you are viewing our sites; and
- Your returning visits and how many page loads; and
- Entry pages, exit pages, visit lengths, most popular pages and other general summary statistics used for web site traffic recording.
- We also record Web browser; and
- visiting habits through the use of "cookies". Non-personally-identifiable information about a user's visiting habits MAY also be automatically collected through the use of cookies. Cookies are computer files that are placed in a user's hard drive to remember any preferences the user may have when surfing the Web. Non-personal, aggregate information collected from cookies help us analyze Web site use. For example, it can tell us how often particular pages are visited. You can set your browser to not accept cookies; however, if you do so, you will not be able to process orders in our online store or have additional secured access to particular pages requiring you to enter login and password information.
Use & Disclosure of Personal Information
Personal information provided to the "Web site Network" may be shared with related companies and partners of the "Web site Network", where it will be kept strictly confidential and will only be disclosed on a need to know basis. The "Web site Network" will use and disclose your personal information for the purpose for which the personal information was initially collected and intended. The "Web site Network" may also use that personal information for a purpose related to the initial purpose of collection if that other purpose would be within your reasonable expectations. Related purposes might include internal auditing and administration, adding your name to a contact list, guest list or invitation list or helping us to identify productions and broadcast activities which may be of benefit or interest to you. The "Web site Network" will not use or disclose your personal information for any other purposes without first obtaining your express or implied consent. The "Web site Network" may however be required to disclose your personal information without your consent if the disclosure is:
- required or authorised by law;
- required in order to investigate an unlawful activity;
- required by an enforcement body for investigative activities; or
- necessary to prevent a serious and imminent threat to a person's life, health or safety, or to public health or safety.
Generally, the "Web site Network" will retain your personal information within Canada and/or the United States and not use or disclose it overseas. However, on some occasions the information may need to be transferred overseas in order to perform one of the "Web site Network" functions or activities outside of North America. In these circumstances, the "Web site Network" will either obtain your express or implied consent or will use its best endeavours to ensure that your personal information will receive the utmost protection similar to that which it would have if the information were strictly held in Canada and/or the United States. As like most business organizations, the "Web site Network" relies on third party suppliers who are contracted or have agreed through other means to conduct specialized activities including but not limited to; travel agencies, tourism agencies, booking agencies, ticket sellers or resellers, hospitality services, hotel and other tourism services, contact call centres, and security services. While personal information may be provided to these suppliers in order to enable them to perform the agreed tasks, the "Web site Network" will make every effort to ensure that the supplier handles the personal information in accordance with the "Web site Network" Privacy Principles and confidentiality practices. The "Web site Network" will require all such suppliers and other third party entities to provide privacy undertakings and enter confidentiality agreements with us.
Direct marketing
From time to time the "Web site Network" may use your personal information to identify production and broadcasting activities and other special events or product offerings and promotions which may be of interest to you. The "Web site Network" may from time-to-time send you information or contact you directly regarding "Web site Network" programs and announcements, along with information through one of our business partners or participating sponsors.
If you do not wish to receive direct marketing information, please let the "Web site Network" know. The "Web site Network" will take immediate steps to ensure that you do not receive any direct marketing information in the future. It may take up to 30 business days to remove your contact information from our systems. We apologize for any future contact that might be made in the interim by us or on our behalf before final removal of your contact information.
Personal Information Quality
The "Web site Network" objective is to ensure that all personal information collected by the "Web site Network" is accurate, complete and always up-to-date. To assist the "Web site Network" in achieving its objective, please contact the Privacy Officer if any of your details change. Further, if you believe that the information the "Web site Network" holds is not accurate, complete or up-to-date, please contact the Privacy Officer in order to have the information corrected.
Personal Information Security
The "Web site Network" is committed to keeping your personal information secure by using industry-standard encryption methods. The "Web site Network" also maintains security protocols using passwords to control and restrict access to authorized staff for approved purposes only. Where information is particularly sensitive, the information is overwritten and then manually deleted.
Your personal information may be stored in hard copy documents, or electronically on "Web site Network" software or system hard disks and servers. The Burlington Jazz and Blues Festival Inc. and its related "Web site Network" maintains physical security over its paper and electronic data storage devices through the use of locks and electronic security systems.
The "Web site Network" will take all reasonable and necessary precautions to protect your personal information from unauthorised access, loss, misuse or alteration and will immediately report to the appropriate authorities any suspicious or malicious use of personal identification. We will not be held liable for malicious or fraudulant data that may be collected by the "Web site Network" and its associated sites by way of the end user (YOU) for the intention of or relating to identity theft. It is your responsibility to make sure you are not a victim of identity theft. It is also your responsibility to report immediately any missing, stolen or lost identification to the appropriate authorities.
Access To Personal Information
You may request access to the personal information the "Web site Network" holds about you.
The procedure for gaining access is as follows:
- All requests for access to your personal information must be made in writing and addressed to the Privacy Officer.
- You must provide as much detail as possible regarding the business entity, department or person to whom you believe your personal information has been provided, and when. This will allow the "Web site Network" to process your request faster.
- The "Web site Network" will acknowledge your request within 14 working business days, and access to information about you will usually be granted within 14 working business days, or if it is more complicated, 30 working business days. The "Web site Network" will inform you if this timeframe is not achievable.
- You will be asked to verify your identity by providing legal government issued photo ID. Passports and Drivers Licenses are the only acceptable means of proving your identity to us; Health Cards and Student Identification cards are not.
- A fee will apply to such access in the event that a request for access is onerous or time consuming. Such a fee will cover staff costs involved in locating and collating information, and reproduction costs.
- Depending on the circumstances, you may be forwarded the information by mail or email, or you may be required to personally inspect your records at the appropriate place.
- You will be given the opportunity to correct any personal information which is no longer accurate.
In some circumstances, the "Web site Network" may not be in a position to provide access. Such circumstances might include, but not limited to:
- frivolous requests;
- providing access which may have an unreasonable impact upon the privacy of other users, members, or other individuals of the "Web site Network";
- access would create a serious threat to safety;
- denying access is required or authorised by law;
- legal proceedings are underway;
- negotiations may be prejudiced by such access; or
- access would reveal a commercially sensitive decision making process.
If the "Web site Network" denies access to your personal information, it will provide you with reasons in writing.
Changes To This Policy
The "Web site Network" may change this Policy from time to time for any reason without notification and will update the Policy accordingly.
Complaints
If you believe that your privacy has been infringed you are entitled to complain. All complaints should initially be in writing and directed to the Privacy Officer. The "Web site Network" will respond to your complaint as soon as possible, within 14 working business days, to let you know who is responsible for managing your query. The "Web site Network" will try to resolve the complaint within 30 working business days. When this is not possible the "Web site Network" will contact you to provide an estimate of how long it will take to handle the complaint.
